Sponsor: CNH America LLC, 120 Brubaker Avenue, New Holland, Pennsylvania 17557.
  1. Entry. The entry period for the 2012 Race With The Winner Boomer 20 Compact Tractor or Rustler 115 Utility Vehicle Sweepstakes ("Sweepstakes") will start at 7:00 am EST on May 18, 2012, and continue through 8:00 pm EST on November 19, 2012. Entrants must register electronically at the website for one of the following 2012 NASCAR Sprint Cup Series Races ("Race Events"):

    • Dover – Dover, DE – June 3, 2012,
    • Pocono – Long Pond, PA – June 10, 2012,
    • Michigan – Brooklyn, MI – June 17, 2012,
    • Daytona – Daytona, FL – July 7, 2012
    • Michigan – Brooklyn, MI – August 19, 2012,
    • Richmond – Richmond, VA – September 8, 2012,
    • Kansas – Kansas City, KS – October 21, 2012,
    • Homestead – Homestead, FL – November 18, 2012.

    No mechanically produced copies will be accepted or eligible to win. To register for the sweepstakes, individuals must provide: Name, address, City, State, Zip, email address, cell phone number. Contest registrants (the "Entrants") will be sent a verification email upon submission of their entry; the verification must be returned for the registration to be considered a valid contest entry. Entrants may register one time for each Race Event, but may not register more than one time for any one Race Event. Only one member of a household (defined as individuals residing at the same address) will be eligible to participate in the Podium Drawing, as further described herein below. Any form of entry other than those described herein is void, and any incomplete or otherwise non-conforming entries will be disqualified. Each entrant’s submission of an electronic entry form certifies that he/she has reviewed a copy of the Official Rules, has read and understands the rules prior to submission, and agrees to abide by all Sweepstakes rules.

  2. Eligibility. The Sweepstakes is open to all legal residents of the fifty United States (and Washington D.C.) or Canada (excluding Quebec) who are of age of majority in their applicable jurisdiction or older as of the date of the Drawing, and upon request by Sponsor, must provide valid identification showing proof of age prior to participation in the Podium Sweepstakes. Entrant must be in attendance at the venue for the Race Event for which Entrant registered in order to participate in the Podium Drawing and to claim the Grand Prize. Determination of an Entrant meeting the eligibility requirements is at Sponsor’s sole discretion. Employees of Sponsor, its subsidiaries, affiliates and authorized dealers, or Michigan International Speedway, Inc., Daytona International Speedway, LLC, Richmond International Raceway, Inc., Kansas Speedway Corporation, Homestead-Miami Speedway, LLC, Pocono Raceway, Dover International Speedway, their respective parent, subsidiaries, limited liability and affiliate companies and the immediate family (spouse, parents, siblings and children, and each of their spouses, regardless of where they live) and household members (whether related or not) of each such person are NOT eligible to enter this Sweepstakes. This Sweepstakes is subject to all applicable federal, state, provincial and local laws and regulations and is void where prohibited by law.

  3. Sweepstakes Rules, Winner Selection and Odds of Winning. At each listed Race Event, there will be a random drawing (the "Qualifying Drawing") at least four (4) hours prior to the start of the respective Race Event in which a number of entrants (the total number of entrants chosen for a given Race Event will be at the Sponsor’s sole discretion and will vary depending on the Race Event) will be selected, from among all eligible entrants registered for that particular NASCAR Race, to participate in a drawing for the Grand Prize which will be awarded in the podium area of the subject NASCAR Racetrack (the "Potential Podium Drawing Contestants"). A certain number of alternate contestants will also be randomly selected in the event one or more of the Potential Podium Drawing Contestants does not qualify or properly respond in the allotted time frame The Sponsor or its designees will then attempt to contact the Potential Podium Drawing Contestants via two (2) channels: an email will be sent to the email address provided by the Entrant at registration, and a call will be attempted to this cell phone number provided by the Entrant. Each message will contain instructions and a time limit for responding and qualifying for the Podium Drawing. This time limit will be strictly enforced. If a Potential Podium Drawing Contestant fails to respond within the allocated time limit, they will be disqualified and an alternate contestant will attempted to be contacted. As a condition for participation in the Podium Drawing, Potential Podium Drawing Contestants must sign and complete a Consent and Release of Liability for both CNH America LLC and the Racetrack facility. The Potential Podium Drawing Contestants, who have qualified for the Podium Drawing (the "Podium Drawing Contestants") will be escorted to the podium area of the subject Racetrack to participate in a brief presentation and random drawing to determine the winner of the Grand Prize (the "Grand Prize Winner"). In addition, if any potential winner is a Canadian resident, he/she must answer unaided a time-limited mathematical skill-testing question as a condition to receiving a prize.

    The final number of Podium Drawing Contestants for a particular Race Event may depend on the number of Potential Podium Drawing Contestants who qualify and agree to participate in the Podium Drawing. The Podium Drawing Contestants and the Grand Prize Winners must be present to win. There will be one Grand Prize awarded to a Grand Prize Winner at each of the listed Race Events. Odds of winning the Grand Prize at each of the NASCAR Race events depends upon the total number of eligible entries entered into the Sweepstakes for that NASCAR Race event by the time of the Qualifying Drawing for the subject Race Event. Grand Prizes available while supply lasts.

  4. Requirements of Podium Drawing Contestants. Podium Drawing Contestants must be willing to go to the podium area of the subject NASCAR Racetrack and participate in the Podium Drawing. If a Podium Drawing Contestant does not appear at the designated gathering place at the given time for the Podium Drawing, as determined by the Sponsor, or if, in Sponsor’s discretion, a Podium Drawing Contestant appears to be intoxicated or acting in an inappropriate manner, Sponsor reserves the right to disqualify this person as a Podium Drawing Contestant.

  5. Grand Prize and Restrictions. At each NASCAR Race Event the Grand Prize will be:

    • The choice of a New Holland BoomerTM 20 Compact Tractor with an approximate retail value of USD $12,175.00 (valuation is in U.S. dollars) OR a New Holland Rustler 115 (4x2) Utility Vehicle ("Grand Prize"), with an approximate retail value of USD $8,837.00 (valuation is in U.S. dollars) (the "Equipment Prize"); and
    • A VIP Experience at the track which will include a visit to Victory Lane for the Grand Prize Winner and a guest selected by the Grand Prize Winner

    If the Grand Prize Winner (and/or the Grand Prize Winner’s guest) does not appear at the designated time and place after the Race Event for the VIP Experience as determined by the Sponsor, or if, in Sponsor’s discretion, the Grand Prize Winner and/or the Grand Prize Winner’s guest appears to be intoxicated or acting in an inappropriate manner, Sponsor reserves the right to cancel the Grand Prize Winner’s VIP Experience (although, in such case the Grand Prize Winner will still win the Equipment Prize).

    Sponsor is not responsible if any scheduled event is delayed, postponed or canceled for any reason. Sponsor will make every effort to reschedule the drawing and Grand Prize fulfillment, if possible, as determined by Sponsor, in its sole discretion. Grand Prize Winner and Podium Drawing Contestants will be subject to verification, including verification of age and must be legally competent, in Sponsor’s sole discretion, to sign the Consent and Release of Liability forms (and Canadian winners must answer the mathematical skill-testing question) in order to take delivery of any prize. The Grand Prize is nontransferable. No prize substitution or cash equivalent is allowed except at the sole discretion of Sponsor. Differences in value of the Grand Prize stated herein and at time of prize notification, if any, will not be awarded. If the Grand Prize cannot be awarded for any reason, Sponsor reserves the right to award a prize of equal or greater value. All federal, state, provincial or local taxes and any registration, license, fees and/or costs related to prize acceptance and/or use are the Grand Prize Winner’s exclusive responsibility. If a U.S. resident, Grand Prize Winners may be issued an IRS 1099 form for prizes over $600.

  6. Equipment Prize Claim. The Sweepstakes winner will be required to sign and return a notarized Affidavit (or Declaration) of Eligibility and Liability/Publicity Release, within fourteen (14) days of initial notification. Failure to comply will result in forfeiture of the Equipment Prize and selection of an alternate winner. The Equipment Prize will be shipped freight prepaid, by ground carrier to the New Holland authorized dealer located nearest to the address supplied on the respective Grand Prize winner’s entry form between June 1, 2012 and January 30, 2013. Dealer will perform pre-delivery preparation on the Equipment Prize and deliver it to the respective Grand Prize Winner’s home address at Sponsor’s expense. Sponsor is not responsible for any change of mailing, email addresses and/or telephone number of Entrants or the Grand Prize Winners.

  7. Use of Information Gathered: Information gathered from Entrants, may be used by Sponsor and its affiliates, as well as International Speedway Corporation and its affiliates, for future marketing purposes, and may be shared with Sponsor's authorized dealers, but will not be sold to any other person or entity. Entrants consent to the use of personal information by entering the Sweepstakes.

  8. Additional Terms. Sponsor retains sole discretion to change or cancel this Sweepstakes in whole or in part and to change the eligibility rules at any time, without prior notice to or the consent of any person or Entrant in the Sweepstakes. Sponsor retains sole and absolute discretion to resolve all questions concerning the administration, interpretation and application of this Sweepstakes, including but not limited to construing the Official Rules, including any disputed or doubtful terms, and determining the eligibility of any Entrant to participate in this Sweepstakes or the eligibility of any Entrant to receive any prize. Sponsor’s determination will be conclusive and binding on all persons. As a condition of participating in the Sweepstakes, Entrants: a) agree that these Official Rules and the decisions of Sponsor shall be final and binding in all respects, b) agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Wisconsin without giving effect to any choice of law or conflict of law rules, c) consent to the jurisdiction and venue of the federal, state and local courts located in Racine, Wisconsin, and d) release, discharge, indemnify and hold harmless Sponsor, Michigan International Speedway, Inc., Daytona International Speedway, LLC, Richmond International Raceway, Inc., Kansas Speedway Corporation, Homestead-Miami Speedway, LLC, Pocono Raceway, Dover International Raceway, their respective parent companies, agencies, limited liability and affiliate companies, subsidiaries, and the respective officers, directors, agents, employees and retailers of each of the foregoing, the Daytona Beach Racing & Recreational Facilities District, the County of Volusia, the City of Daytona Beach and the City of Homestead from any and all liabilities, claims, loss, damages or injuries of any kind arising from or incurred in connection with entrant’s participation in the Sweepstakes, and/or the acceptance, possession or use of the Grand Prize awarded, or participation in prize-related activities, such as the Podium Drawing and the VIP Experience. The execution of additional releases and/or waivers of liability required by Michigan International Speedway, Inc., Daytona International Speedway, LLC, Richmond International Raceway, Inc., Kansas Speedway Corporation, Homestead-Miami Speedway, LLC, Pocono Raceway, Dover International Speedway and/or any other applicable sanctioning body or prize provider may also be required and returned within the time period specified by such entities, as appropriate. By accepting the Grand Prize, the Winner grants permission (and agrees to confirm this grant in writing if requested) to Sponsor and those acting under the Sponsor’s authority to use winner’s name, pictures/portraits/likenesses and/or voices, for advertising, trade, publicity and promotional purposes in commerce and in all media worldwide without territorial or time limitation or additional compensation. Winner must comply fully with these Official Rules in order to receive the Grand Prize. By accepting the Grand Prize, the winner further acknowledges that Sponsor and its agents, their respective parent companies, affiliates and subsidiaries, and the officers, directors, agencies, agents and employees of each of the foregoing, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to such prize including, but not limited to, its quality, condition or fitness for a particular purpose. Sponsor is not responsible for printing or typographical errors in any Sweepstakes related material, or for stolen, lost, late, misdirected, damaged, incomplete, or illegible entries. Entrant acknowledges and agrees that any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs, and under no circumstances will Entrant be permitted to obtain an award for, and Entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages. Further, Entrant agrees that all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action.

  9. Limitation of Liability. Sponsor is not responsible for: i) lost, late, incomplete, illegible, damaged, garbled, destroyed, deleted, or misdirected entries, or entries not received by Sponsor for any reason; ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operations or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for the destruction or alteration of entries; iii) failed or unavailable hardware, network, software or telephone transmissions, damage to Entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; or iv) any entries submitted in a manner that is not expressly allowed under these Rules. All incomplete or otherwise non-conforming entries will be disqualified. Sponsor reserves the right to void any entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any Entrant using such a method. If for any reason this Sweepstakes cannot be executed as planned, for reasons including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, delay in operation or transmission, communications line failure, technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity, or proper conduct of this Sweepstakes, or if this Sweepstakes is compromised or becomes corrupted in any way, Sponsor reserves the right to terminate the Sweepstakes in its sole discretion. If the Sweepstakes is terminated before the scheduled end date, Sponsor reserves the right to select the winner by random drawing from among all eligible, non-suspect entries received as of the termination date. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY MACHINE OR OTHERWISE TAMPER WITH OR CORRUPT THE SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY PERSON ATTEMPTING SUCH CONDUCT TO THE FULLEST EXTENT PERMITTED BY LAW. Entrants may not use any device or artifice to register multiple times per day or as multiple registrants. Any Entrant who attempts to enter under multiple identities or uses any device or artifice to register multiple times per day may be disqualified and may forfeit any and all prizes won, in Sponsor’s discretion.

  10. Copy of Official Rules / Winner Identification. For a copy of these Official Rules or for the names of the Grand Prize Winners, send a self-addressed, stamped envelope by December 31, 2012, to: 2012 Race With The Winner BoomerTM 20 Compact Tractor or Rustler Sweepstakes Winner List, 120 Brubaker Avenue, MS 209, New Holland, Pennsylvania 17557. Canadian residents may omit return postage.

  11. Name Removal. If you would like your name removed from the list of future sweepstakes mailings, write to New Holland, 120 Brubaker Avenue, New Holland, Pennsylvania 17557.
